Cisco’s claims on the Iphone trademark might just be too fuzzy to win a lawsuit against Apple. It appears that Cisco had to file a “Declaration of Use” with the US Patent and Trademark office for the Iphone trademark every six years. It’s last deadline was November 16, 2005. Not only that, Cisco had to demonstrate that it’s actually using the Iphone name.
Well, Cisco does in its Linksys Skype Phone but an Iphone sticker on the box may not be sufficient, and there seems to be no reference of an “Iphone” under the Linksys brand or in any Cisco product. Also noted are other trademark-violating uses of the name Iphone by other companies including Earthlink and the Internet Phone Company, which actually owns the website www.iphone.com.
